Conditions of Contract

1) Definitions

The licenses granted by FREE MUSIC PROJECTS (hereinafter the "Agreement") constitute the entire agreement between you (hereinafter the "Licensee") and FREE MUSIC PROJECTS, www.freemusicprojects.com holder (hereinafter the "Site").

The Licensee can not use any audio or other content without the acceptance of the limit of uses as described in each License Class. If the Licensee does not agree with FREE MUSIC PROJECTS in the terms defined in this Agreement, please discontinue using the Site and do not proceed with the purchase of the royalty free music licenses.

2) License guarantee

In consideration of the acceptance by the Licensee of the terms of this Agreement and payment of the invoice of the license, FREE MUSIC PROJECTS grants to the Licensee, by a non-transferable and non-exclusive license, anywhere in the world and without time limit, to publish, create, and distribute works, whose content includes part of the licensed work, and under the limits and conditions described in each License Class detailed below:

1. CLASS A LICENSE
Uses are limited to: Background music for websites, banner ads, blogs, podcasts, non-commercial multimedia presentations, (non-commercial) theatre performances, phone calls on hold and answering machines. 
Duration: Unlimited.
Territorial scope: Worldwide. 
Character: Nonexclusive and nontransferable license.

2. CLASS B LICENSE 
Uses are limited to: Advertising on television and / or radio (local), music tv header and / or radio (local), documentaries, short films, commercial multimedia presentations, corporate videos, theater performances (commercial) and public events.
Duplication: Up to 1000 copies.
Duration: Unlimited.
Territorial scope: Worldwide.
Character: Nonexclusive and nontransferable license. 

3. CLASS C LICENSE 
Uses are limited to: Advertising on television and / or radio (national), music television header and / or radio (national), feature films and video games.
Duplication: More than 1000 copies.
Duration: Unlimited.
Territorial scope: Worldwide. 
Character: Nonexclusive and nontransferable license.

Once the invoice has been paid, the Licensee is not required to make any additional payment to FREE MUSIC PROJECTS or any other organisation for the use of the content of the license, provided such use conforms the terms of this Agreement and the limits of use outlined in each License Class.

3) Restrictions on use

a. The exploitation of musical works without sync on other work or recording.  
b. The exploitation of musical works by copying, manufacture or distribution, and by rental, license or sale.  
c. Use of the musical works in any way that violates the law of any jurisdiction.

4) Indemnification

The Licensee assumes all responsibility for the use of the licensed content. The Licensee must indemnify FREE MUSIC PROJECTS in the case of any violation of this Agreement or breach of the uses of each License Class.

5) Duration and termination

The License contained in this Agreement will terminate automatically without notice from FREE MUSIC PROJECTS if the Licensee fails to comply with this Agreement. In the event of termination, the Licensee shall immediately: 
a. Stop using the licensed content.  
b. Destroy the licensed content.

6) Payment

a. All license sales are definitive and can not be refunded under any circumstances, except for physical defects of the audio file (Mp3) or failure during the download process. Prices, offers and downloads are subject to availability and may be changed at any time. 
b. The Licensee is responsible for payment of the invoice. 
c. The invoice will be the document that certifies that the purchaser is the holder of the exploitation rights defined by each License Class.
d. Once the payment is confirmed, the Licensee will have access to a private client area where they can download the audio file (MP3 format 320 Kbps) and the invoice.  

7) Legal Recognition

a. By clicking "I accept conditions of agreement", the Licensee accepts this Agreement with FREE MUSIC PROJECTS, and agrees to comply with its dispositions. 
b. The Licensee confirms that they are of at least 18 years of age and have full legal rights and authority to enter into this Agreement. The Licensee also confirms that the information they have provided to FREE MUSIC PROJECTS is true and accurate, including and without limitation, all credit card infomation, and agree to update that information when necessary. 
c. The Licensee acknowledges that they have read and understood this agreement, and has had the opportunity to seek legal advice before accepting it. The Licensee agrees to comply with the terms and conditions of this Agreement.

8) Legislation and jurisdiction

FREE MUSIC PROJECTS and the user of the Site, submit any disagreement that may occur to the Spanish Law, with the express reference to the jurisdiction of the Courts of Madrid, and agree to expressly renounce any other jurisdiction which could apply.
